Xlay Technologies Inc. (“Xlay”, “we”, “us”) operates the Xlay rideshare platform, including the Xlay rider app, the Xlay driver app, and related websites and services (together, the “Services”). This policy explains what personal information we handle and why.

2. Information we collect

Information you give us

• Account details — name, phone number, email, and profile photo.
• Driver details — for drivers: vehicle information, driver’s licence, insurance, and any documents required to drive.
• Payment details — handled by our payment processor; see section 6.
• Communications — messages, ratings, and support requests.

Information we collect automatically

• Location — pickup, drop-off, and live trip location (see section 5).
• Trip data — routes, distance, time, fares, and history.
• Device and usage data — device type, app version, and diagnostic logs.

3. How we use it

• Match riders with drivers and complete trips.
• Calculate fares, process payments, and issue receipts.
• Show live tracking and navigation during a trip.
• Keep the platform safe — verify drivers, prevent fraud, and respond to incidents.
• Provide support and send service notifications.
• Meet legal, tax, and regulatory obligations.

4. When we share it

We share personal information only as needed to run the Services:

• Between riders and drivers — limited details (such as first name, pickup, and live location) so a trip can happen.
• Payment processors — to charge riders and pay drivers.
• Service providers — mapping, cloud hosting, messaging, and analytics partners acting on our behalf.
• Legal and safety — when required by law, or to protect the rights and safety of users and the public.

We do not sell your personal information.

5. Location data

Location is core to a rideshare service. With your permission, the rider app collects location to set pickups and show your driver; the driver app collects location while online so we can dispatch trips and show the car to riders in real time. You can turn off location permissions in your device settings, but the Services will not function without it.

6. Payment data

Card payments are processed by our third-party payment processor. Xlay does not store full card numbers on its own servers. Your use of payments is also subject to the processor’s terms and privacy policy.

7. Retention

We keep personal information for as long as your account is active and as needed to provide the Services, then for any additional period required to meet legal, tax, accounting, and dispute-resolution obligations.

8. Security

We use reasonable technical and organizational measures to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Your choices and rights

Depending on where you live, you may have the right to access, correct, or delete your personal information, or to withdraw consent. To make a request, contact us at privacy@x-lay.com. You can also manage permissions and notifications in your device and app settings.

10. Children

The Services are not directed to children under the age of majority in their jurisdiction, and we do not knowingly collect their personal information.

11. Changes

We may update this policy from time to time. If we make material changes, we will update the “last updated” date and, where appropriate, notify you in the app.
